Terms of Service
Last updated: 23 October 2026
1. This agreement
These terms are between Hypershots (“we”, “us”) and the business that subscribes to Hypershots Jewellery AI (“you”, “your shop”). By buying a plan or using the service you accept them. If you are agreeing on behalf of a shop, you confirm you are authorised to do so.
They should be read with our Privacy Policy and our Refund and Cancellation Policy. Those documents, the pricing page and anything we tell you at checkout say the same thing; if you ever find them in conflict, tell us and we will fix it.
2. What we provide
We provide an AI marketing service, operated through WhatsApp, that creates posts, reels, captions, catalogues, invoice drafts, campaign plans and reports for your jewellery shop, and publishes approved content to the platforms you have connected. What is included, and in what quantity, is set out on the pricing page for the plan you bought.
Some features are released after launch, or depend on a platform approving our access. The pricing page marks each of those with a note saying when it arrives and what it depends on. We do not charge extra when such a feature becomes available on your plan, and we do not guarantee a date for an approval that is not ours to give.
3. Approvals and autonomy
- Anything public, customer-facing or involving money waits for your approval before it happens.
- You may choose to let a routine item — for example the daily rate post — publish without a tap. You can withdraw that permission at any time.
- Advertising spend is different: starting a campaign or increasing a budget always needs your explicit approval, every time, and is subject to the caps you set. Our agents may reduce spend on their own. They may never increase it.
- Messages to your customers require that customer's consent, your approval of the campaign, and the rupee cost shown to you before sending.
- Once you approve something, you are responsible for it being published. We keep a record of what was approved, by whom and when.
4. Your responsibilities
- Accuracy. Gold and silver rates, weights, purity, HUID numbers, making charges and prices come from you. We never invent them. You are responsible for checking that what you approve is correct before it goes out.
- Rights in your content. You confirm you own, or are licensed to use, every photo, video, logo and design you send us, and that publishing it does not infringe anyone else's rights.
- Consent for customer messaging. You confirm that the customer contacts you give us were collected lawfully and that you have the right to ask us to message them. You remain the data fiduciary for your customers' personal data.
- Lawful use. You will not ask us to produce misleading price claims, copies of another jeweller's designs, fake reviews, or anything that breaks the platforms' policies or Indian law. We may refuse such a request.
- Your account. Keep control of the WhatsApp number used to approve things. Approvals from that number are treated as yours.
5. Advertising spend
Advertising is bought on your own Meta ad account with your own payment method, and Meta charges you directly. We never hold, route or take a percentage of your advertising money, and it is not part of your plan fee. WhatsApp marketing messages are charged by Meta at its own rates and passed through to you at cost from a prepaid balance, with the cost shown before each send.
6. Who owns what
- You keep ownership of the photos, videos, logos and brand material you send us.
- The creatives, captions, reels and catalogues we produce for your shop are yours to use, including after you stop being a customer.
- We keep ownership of the service itself — the software, the models and prompts we build, the templates and the platform. Nothing here gives you a licence to it beyond using the service.
- You grant us permission to use your material only to provide the service to you. If we would like to use your shop as a public case study, we will ask you first and you can say no.
7. AI-generated content
Content is drafted by AI models and shown to you before it is used. Creatives for a piece you are selling keep the real piece from your photograph; only background and lighting change. A design that does not exist yet is labelled as a concept created using AI, in line with the Advertising Standards Council of India's guidelines. We are not responsible for a claim you approve that turns out to be inaccurate.
8. Third-party platforms
Publishing, messaging and advertising depend on Meta, Google and other platforms, and on their terms and approvals. We cannot guarantee that a platform will remain available, that it will approve an account or an advertisement, or that it will not change its rules or its metrics. A platform outage or a platform decision is not a failure of our service, though we will tell you when one affects you.
9. Payment, GST and renewal
- Prices shown include 18% GST. You receive a GST invoice for every payment.
- Plans are paid in full at the start of the term.
- A plan does not auto-renew without warning. We send a reminder before your term ends and you choose whether to continue.
- Allowances reset monthly and do not carry over. We tell you at 80% of an allowance and ask you before charging for anything extra.
- We may change our prices, but not during a term you have already paid for.
10. Cancellation and suspension
You may cancel at any time; your plan then runs to the end of the term you paid for and stops. Refunds are covered by the Refund and Cancellation Policy.
We may suspend or end the service if you do not pay, if you use it to break the law or a platform's policies, or if a platform withdraws our access. Where we reasonably can, we will warn you first and give you a chance to put it right.
11. Liability
We provide the service with reasonable skill and care, but we do not promise particular business results — we cannot guarantee reach, leads, followers or sales.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Subject to that, our total liability to you for any claim is limited to the fees you paid us in the three months before the event giving rise to the claim, and we are not liable for loss of profit, loss of business or indirect loss.
12. Changes to these terms
We may update these terms. We will tell you in your WhatsApp chat before a change that materially affects you takes effect, and the date at the top of this page will change. If you do not accept a change, you may cancel and we will refund the unused part of a term you have prepaid.
13. Governing law
These terms are governed by the laws of India, and the courts of Maharashtra, India have exclusive jurisdiction over any dispute. Before going to court, please contact us so we can try to resolve it.
